The criteria to determine whether an Essential Services Agreement (ESA) is necessary for your organization is enumerated in the Labour Relations Code. Ahrens Group will evaluate this requirement and, if necessary, lead your ESA negotiations through to successful conclusion.
Immediately upon a union’s application for certification, no changes can occur to employee rates of pay, terms, conditions, rights, or privileges (except in accordance with an established custom or practice). If the union is certified, and serves Notice to Bargain, the “freeze” continues an additional 120 days (unless a collective agreement is reached).
